What HIPAA changes about a phone agent
A restaurant host and a dental coordinator both answer phones. Only one of those conversations can include protected health information (PHI). HIPAA changes the default from “collect everything useful” to “collect the minimum the job needs, store it where your policies already allow, and do not invent clinical content.”
A useful clinic agent still has a job. After-hours on Baltimore Drive, Coast Highway, Third Avenue, or a UTC medical building is a new-patient request and a pain call. The agent can take CallerANI, CallbackName, PreferredLanguage, ReasonCode (new patient, reschedule, billing, pain, other), and offer two published times. The agent should transfer pain that sounds urgent. The agent should not say what the pain means.
HIPAA also changes vendors. The PMS, the text vendor, the voice over Internet protocol (VoIP) host, the call-recording box, and the model host may be business associates if they touch PHI. That analysis is counsel’s. Implementation’s job is to name every system the audio and the row will enter. Unnamed systems are how clinics get surprised.

A covered entity (the clinic) may need a BAA with a vendor that creates, receives, maintains, or transmits PHI. Ask every phone vendor four questions.
- Will you sign a BAA for this product, in writing, before go-live?
- Where is audio stored, for how long, and who can replay it?
- Is there a subprocessors list for speech-to-text and the model?
- Can we turn off training on our audio?
If the answer to the first question is no and your counsel says the vendor will hear PHI, do not go live. Pickup is not worth a contract gap. If the vendor will sign and your counsel is satisfied, you still need a refuse list. A BAA is not a license for the agent to read a chart.
SaaS tools (FrontDesk, DentalAssist, Rosie, Goodcall, Smith.ai, Voksha) publish their own security and BAA pages. Read the live documents. What an agent may say and must not say
Write two columns on a whiteboard. Allowed. Forbidden. The allowed column should be short.
Allowed examples: we are an automated assistant for [ClinicName]. I can take a callback, book a published new-patient or hygiene slot, send an intake link, or transfer you. What is the best number. Do you prefer English or Spanish. The next available times I can offer are [SlotA] and [SlotB]. If this is a medical emergency, hang up and call 911 or go to urgent care.
Forbidden examples: what your symptoms mean. What the dentist will do. Whether insurance will pay. Reading a prior chart. Confirming a procedure the caller names unless the PMS row already shows it and counsel approved that confirmation. Inventing a diagnosis from a photo. Promising a same-day surgical slot the book does not have.
Pain is a transfer, not a conversation. Billing is a transfer or a callback to the biller. Records requests are a transfer. Media and legal threats are a transfer. The receptionist already knows this tree. The agent only works if you write it.
Spanish-first South Bay clinics must approve both columns in the owner’s Spanish. A translated forbidden list that sounds rude will get turned off. Tone is operational. It is also how callers disclose more PHI than you asked for. The agent should not chase extra story.
California recording and automated-voice language still belongs to counsel. Put their sentences in the greeting. This page will not invent them.
SaaS receptionists on a clinic line
Subscriptions are often the right first clinic buy. After-hours pickup this week. A morning list. A transfer to the on-call dentist. If you can live with the script and counsel accepts the BAA, start there.
Custom work starts when three things are true. Booking must write AppointmentType, ProviderId, OperatoryId, LocationId (Encinitas versus Del Mar, or two South Bay suites). The script must match the dentist’s sentences, including Spanish. Someone on payroll must edit ScriptVersion without a week-long ticket.
